Terms of Service
Effective: June 7, 2026
These terms describe the agreement between Fundly and the organizations, advisors, and supporters who use it. By creating an account or contributing to a campaign, you agree to them.
What Fundly is
Fundly is a fundraising platform for K-12 schools, PTAs, booster clubs, and similar US-based youth organizations. It lets authorized advisors and org admins run donation drives and product-sale campaigns, with students participating under adult supervision. Fundly provides the technology; the organization is responsible for the campaign itself.
Who can use it
Account holders must be at least 18 and authorized to act for the organization. Students aged 13 and older may participate in campaigns run by an adult advisor; no one under 13 may create an account or have personal information collected. A student's 13+ status is established by an attestation from a responsible adult — the advisor or the organization's admin — not by the student typing in a date of birth; that attestation is recorded with the adult's identity, the method, and a timestamp. Advisors are responsible for the actions of the students they invite to a campaign.
Campaign rules
Campaigns must accurately describe their purpose and how funds will be used. Fundraising for the personal benefit of an individual is not permitted. Raffles, sweepstakes, drawings for chance-based prizes, lotteries, and similar games of chance are prohibited on Fundly. Misrepresentation, fake charities, and high-pressure tactics are not allowed. The organization — not Fundly — is responsible for honoring donor intent and delivering any promised items.
Payments and fees
All donations and sale proceeds are processed through Stripe Connect and sent directly to the organization. Fundly takes no percentage of donations or sales. We charge a one-time launch fee per campaign, described in Fees & Refunds. Card processing is handled by Stripe under its own terms, and by using Fundly you agree to Stripe's connected-account requirements.
Prohibited uses
You may not use Fundly to break the law, to deceive donors, to fund individuals, to run chance-based promotions, to distribute harmful or age-inappropriate content, or to violate our Acceptable Use Policy. We may suspend or terminate organizations, or remove individual campaigns, that breach these terms.
Limitation of liability
Fundly is provided "as is" and "as available." To the maximum extent permitted by Delaware law, Fundly is not liable for indirect, incidental, or consequential damages arising from your use of the service. Our total liability for any claim is limited to the amount you have paid Fundly in the twelve months before the claim. This agreement is governed by the laws of the State of Delaware.
